Terms and Conditions

A booking once made, will be subject to the following terms and conditions:

CONTRACT
A contract will exist between ourselves (the Property Owners) and you, (the Client), who confirms being over 18 years of age, and is named as and taken to be the Party Leader, thus agreeing to accept responsibility for all other members of the party and matters relating to the holiday.

A rental agreement is for short term holiday occupation only, between the agreed dates.

We will confirm your booking once we are in receipt of a deposit or full balance if within six weeks of arrival. A completed, signed booking form is also required. However, the deposit itself shall be taken as indication of your acceptance of all our Terms and Conditions. A contract will exist from the time we issue our confirmation of your booking.

Only those named at the time of booking will be accepted for occupation of the accommodation. Sub-letting or over occupation is strictly prohibited. Failure to comply may result in refusal of admittance or termination of your booking without refund.

The maximum number to reside in the Property must not exceed 4 in the Casita, unless with the Owners written permission. Where there is a group of same sex people we reserve the right to refuse the booking.

DEPOSIT and PAYMENT OF BALANCE
A 25% deposit is required upon booking. This is NON-refundable. The balance payment must be received by us no later than six weeks before the holiday commencement date. Please ensure you allow at least 2 days for the balance to be transferred to our bank account. Where an outstanding balance remains unpaid after the due date has elapsed, we reserve the right to cancel the booking and apply the relevant cancellation charges. A final reminder will normally be emailed prior to the due date, but this should not be relied upon, and we take neither responsibility for its non-receipt nor any subsequent late payment.

CANCELLATION
In the unlikely event that we have to cancel your booking, we will make every effort to offer you an alternative, or refund all monies paid.

A cancellation request by you, the Client, should be made in writing, either by email or fax, and be issued by the party leader who originally contracted the holiday.

If notification is received more than 42 days before the rental commencement date then only the deposit will be retained by us. If notification is received less than 42 days before the rental commencement, refunds of amounts paid will be made if the Owners are able to re-let the property, and any expenses or losses incurred in so doing will be deducted from the refundable amount. The Client is strongly recommended to arrange a comprehensive travel insurance policy (including cancellation cover) and to have full cover for the party’s personal belongings, public liability etc, since these are not covered by the Owner’s insurance.

PETS/NO SMOKING
We are unable to accept pets and it is also important to note that within the Property, smoking is restricted to outside areas only.

SERVICES/RESPONSIBILITIES
We have naturally taken every care to ensure that the information we provide is accurate. We accept no responsibility for events beyond our reasonable control, such as inconvenience caused by neighbouring land or property owners, clients, tenants, animals or failure of utility services such as electric, water or electrical/gas equipment. Where we are made aware of any adverse conditions which we consider may affect the enjoyment of your holiday, we will notify the party leader immediately. In the case of such circumstances arising without our former knowledge, we accept no liability.

All electrical/gas appliances are used at the guest’s discretion and responsibility. The Owners take very seriously the cleanliness of your accommodation on arrival, pool cleaning and condition of BBQ’s etc., as is the provision of bed linen, towels and other facilities such as TV/DVD/CD player. Occasionally certain matters are beyond our reasonable control. Should you be unhappy with any aspect of your accommodation, please notify us immediately, and we will do our best to help resolve the matter.

CLEANING
You, the Client, agrees to be a considerate tenant and accept responsibility for taking reasonable care of the property and its security during occupation, notifying us of any breakages, which may result in a charge for repair or replacement. The Client agrees to take good care of the Property and to leave the property in a clean and tidy condition upon departure and to strictly observe all notices/information that may exist, relating, for example, to fire risk, health and safety.

KEYS
The Client also accepts responsibility for the keys whilst they are in their possession, and their safe return. A charge will be levied for lost keys – ie, key replacement which cannot be guaranteed same day; this may also include locksmith fees for gaining access to the property – which again may not be possible to arrange immediately.

BREAKAGE DEPOSIT
A refundable breakage deposit of £150 is required on arrival. We reserve the right to deduct any charges relating to breakages from this deposit, or to withhold any costs incurred by additional cleaning having arisen from the property being left in a less than satisfactory state. Clients are asked to replace breakages, wherever possible, prior to their departure or at the very least notify us at the earliest opportunity.

COMPLAINTS
In the unlikely event of a complaint, it is important that you notify us immediately or as soon as possible. We will then need time to assess and resolve the situation. This is particularly important where other tradesmen are involved as it can take more time here in Spain. Where any dissatisfaction with the property continues to exist, we will aim to make every possible and practical attempt to resolve the matter amicably. We are unable to consider complaints submitted to us once you have returned home, where they were not brought to our attention at the time they arose. In the case of any disputes, we will deal with the party leader only. Any written complaints following an initial notification must be received by us within 21 days of your departure.

ARRIVAL AND DEPARTURE TIMES
In order to allow time to prepare for each new arrival, your holiday accommodation will normally be available from 4pm on the day of arrival until 11am on the day of departure. Any deviation from this must be agreed in advance.

DIRECTIONS TO THE PROPERTY
Our Property is located a few minutes from the main road at Estacion de Cortes de la Frontera. The lane to our house, signposted “via pecuaria”, is cemented with the last 50 metres of the track being unmade. The driveway and car park are totally cemented. We will supply comprehensive written directions to our Property, which have been tried and tested. We are unable to accept responsibility however, where roads may become temporarily closed or routes altered without our prior knowledge. The Party Leader is responsible for ensuring he/she is in possession of the directions together with the details for collecting and returning the keys.

CAR HIRE
Car hire is not only recommended but essential. If you are in any doubt, please contact us.

SWIMMING POOL/SAFETY
Pool maintenance is carried out to ensure correct levels of chemicals and cleanliness. A pool net is provided for use by the Client to remove debris, such as leaves. This may involve the occasional and usually only slight disruption. Glasses are prohibited to be used on the pool terrace.

Children are not permitted to use the Pool or Pool Garden without being accompanied and under the supervision of an adult. This is a mandatory requirement where ANY pool exists, and especially where swimming pools are not fenced in. No diving, no jumping into and no running around the pool and no undesirable behaviour in the pool. Children who cannot swim must use a suitable flotation device (such as arm-bands).

The pool is in use between March and October, heated solely by the sun. Please note the water temperature will therefore only reflect external weather conditions and temperatures.

Candles, fires, naked flames are prohibited outside as the property is governed by the National Park Regulations. Cooking is only permitted in the kitchens and BBQ facility. Smoking is only permitted outside (ashtrays provided) any resulting damage from smoking is the responsibility of the tenant.

During winter rentals a basket of logs is supplied for the wood burner. A gas bottle is also supplied for the BBQ.

PROPERTY/GARDEN MAINTAINANCE
This is a working vineyard. Routine repairs and garden upkeep may be required but we will endeavour to ensure that any interruptions are kept to a minimum.

DOMESTIC ANIMALS and the local wildlife
There is generally a different approach here to domestic animals, many of whom may appear to be left to wander where they please.

SATELLITE TV & Wi Fi
Satellite TV is provided in the Casita and a wireless connection is available throughout the property, including the terraces. These can be interrupted due to weather conditions. English channels are no longer available due to the migration to a new satellite with a shorter range. Most of Europe can no longer have access to the channels. Streaming sometimes works.

BATHROOMS
This description could apply to a shower room – without bath. A septic tank is installed therefore please ensure that nothing, except human waste & toilet paper, is flushed down the toilet. On no account must excess paper, cigarette butts, nappies, tampons etc. be deposited in the toilet.

LIABILITY
The Owners shall not be liable to the Client:

  • For any temporary defect or stoppage in the supply of public services to the Property, nor in respect of any equipment, plant, machinery or appliance in the Property, garden or swimming pool,
  • For any loss, damage or injury which is the result of adverse weather conditions,
  • Riot, war, strikes or other matters beyond the control of the Owners,
  • For any loss, damage or inconvenience caused to or suffered by the Client if the property shall be destroyed or substantially damaged before the start of the rental period and in any such event, the Owners shall, within seven days of notification to the Client, refund to the Client all sums previously paid in respect of the rental period.
  • Under no circumstances shall the Owners liability to the Client exceed the amount paid to the Owners for the rental period.
  • The Owners do not accept liability for loss of life, injury or personal accident, nor can they accept responsibility for any loss of possessions during your stay.

WHEN IN SPAIN . . . . . .
AND FINALLY, the Spanish way of life has MUCH to commend it, however, electricity and water supplies may be erratic; power supplies fail and water shortages occur – for apparently no reason. In latter years this is now rare and mainly occurs due to adverse weather conditions. Whilst our beautiful rural location is far removed from the bustle of city life, the countryside has sounds of its own; cockerels crowing, donkeys baying, bullfrogs croaking, mosquitoes buzzing, dogs barking, occasional train passing along nearby track but no cars and traffic jams. All this is an integral part of country life – which has an appeal all of its own.

During summer months town water is precious, please be conservative with the use of water and do not run hoses or attempt to top-up the pool with town water.
